BACKGROUND AND PURPOSE
Under current law state agencies may, under certain conditions, contract with a third party for Internet application development that duplicates a TexasOnline function. C.S.H.B. 2048 would require that the Department of Information Resources be granted an opportunity to bid on such developments if a state agency solicits bids from third parties. The bill also provides that each state agency shall advertise options for completing transactions with that agency online.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
C.S.H.B. 2048 requires state agencies, under certain circumstances, to provide the Department of Information Resources an opportunity to bid on a project that proposes to duplicate a TexasOnline function before that state agency may contract with a third party for internet application development. The bill also requires state agencies that use TexasOnline to advertise the option of completing transactions with the agency online.
EFFECTIVE DATE
On passage if the necessary vote is received, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
COMPARISON OF ORIGINAL TO SUBSTITUTE
Deletes "The department must be provided the opportunity to bid" and adds "The department may exempt a state agency from this section if it determines the agency has fully complied with Section 2054.111" and changes the words "program management office" to "department".
