BACKGROUND AND PURPOSE

 

Under current law, political subdivisions are currently prohibited from changing the date of their general elections.  While this provision keeps local entities from changing the date of their elections from year to year, it also keeps some from changing to a more convenient date.  House Bill 2151 would allow these local governing units to change their general election to another uniform election date by December 31, 2005.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

 

ANALYSIS

 

House Bill 2151 amends the Election Code to authorize a political subdivision other than a county to change the date of its general election to another authorized uniform election date not later than December 31, 2005, rather than December 31, 2004.

 

The bill prohibits an election on the new date from being held prior to the May uniform election date in 2006, rather than 2004.

 

 

EFFECTIVE DATE

 

Upon passage, or if the Act does not receive a vote of two-thirds of the members elected to each house, September 1, 2005.
