BACKGROUND AND PURPOSE

 

The students of Midwestern State University (MSU) have voted to authorize an increase in fees to provide for a student recreation center and expanding of a health center.  CSHB 2272 authorizes a student fee to be charged for the financing, constructing, operating maintaining, and improving a student recreation center or health center at MSU.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1 -  Subchapter E, Chapter 54, Education Code, is amended by adding Section 54.5441 to authorizes, beginning with the 2007 spring semester, the board of regents of MSU to charge each student registered at the university a fee not to exceed $130 for each semester of the regular term or summer session of 12 weeks or longer and not to exceed $65 for each summer session of less than 12 weeks.

 

The fee may not be increased by more than 10 percent from one academic year to the next without approval by a majority of students in an election called for such a purpose.

 

SECTION 2 - These changes in law will apply beginning on the semester or term on or after the effective date of this Act.

 

SECTION 3 - Effective date.

 

EFFECTIVE DATE

 

September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute adds that the fee may not be increased by more than 10 percent from one academic year to the next without approval by a majority of students in an election called for such a purpose.  The substitute clarifies the method of collection and disposition of the fee, and that the amount of the fee will not be counted toward the maximum student service fee that may be charged.
