BACKGROUND AND PURPOSE

 

The Product Development and Small Business Incubator Board was authorized in the Economic Development and Tourism Office in the Office of the Governor by Senate Bill 275 of the 78th Legislature, effective September 1, 2003.  As enacted by SB 275, Government Code, Section 489.203(c) provided that nine appointed board members serve for “two-year staggered terms, with the terms of three members expiring February 1 of each odd-numbered year.”  In addition, the transfer provisions in Section 2.03 of SB 275 provided that “the governor shall designate three members for terms expiring February 1, 2005, three members for terms expiring February 1, 2007, and three members for terms expiring February 1, 2009.”  Thus, six-year terms were intended.  This legislation amends Government Code, Section 489.203(c) to clearly provide for six-year staggered terms

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Subsection (c), Section 489.203, Government Code, to change the board terms from two-year staggered terms to six-year staggered terms.
 
SECTION 2.  Provides the effective date of this Act.

 

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
