AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Local transit departments should be allowed to decide where bus stops should be located along a road and use their own funds to construct adjacent areas for buses to safely board and disembark passengers.  H.B. 2348 allows local transit departments the authority to construct a separate area adjacent to a highway so that buses may safely board and discharge passengers without impeding the flow of traffic. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 453.107, Transportation Code, by adding Subsection (d), as follows:

 

(d)  Requires the Texas Department of Transportation (TxDOT) to permit a transit department to construct a separate area adjacent to a highway under the jurisdiction of TxDOT so that buses may safely board and discharge passengers without impeding the flow of traffic.  Requires the location, design, and construction standards of an area constructed under this subsection to be approved by TxDOT to ensure the safety of the traveling public. 

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
