AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Chapter 2167, Government Code, authorizes the Texas Building and Procurement Commission (commission) to contract with one or more private brokerage or real estate firms to assist the commission in obtaining lease space for state agencies on behalf of the commission.

 

Currently, the commission has no way to compensate a private firm for reducing lease costs, other than to allow them to receive a commission from the landlord.  The commission needs to be able to recover these costs directly and make payments to the private firm, as appropriate.

 

H.B. 2377 authorizes the commission to establish a system of charges and billings to recover the costs of contracting with a private brokerage or real estate firm.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 2167.0541, Government Code, by adding Subsection (c), to authorize the Texas Building and Procurement Commission (commission) to establish a system of charges and billings to recover the costs of contracting with a private brokerage or real estate firm in obtaining lease space for state agencies on behalf of the commission under this section.

 

SECTION 2.  Effective date:  upon  passage or September 1, 2005.
