BACKGROUND AND PURPOSE

 

Chapter 2167, Texas Government Code, authorizes the Texas Building and Procurement Commission (TBPC) to contract with one or more private brokerage or real estate firms to assist TBPC in obtaining lease space for state agencies on behalf of TBPC.  Currently, TBPC has no way to compensate a private firm for reducing lease costs, other than to allow them to receive a commission from the landlord.  TBPC needs to be able to recover these costs directly and make payments to the private firm as appropriate.  HB 2377 authorizes TBPC to establish a system of charges and billings to recover the costs of contracting with a private brokerage or real estate firm. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that rulemaking authority is expressly granted to the Texas Building and Procurement Commission in Section 2167.0541(c), Government Code. 

 

ANALYSIS

 

Section 2167.0541, Government Code, is amended by adding Subsection (c) , authorizing TBPC to establish a system of charges and billings to recover the costs of contracting with a private brokerage or real estate firm.
