BACKGROUND AND PURPOSE
Currently, Texas Building and Procurement Commission (TBPC) has the responsibility of providing a child care services for state employees. TBPC is required to appoint a child care advisory committee, which is responsible for establishing child care standards and curriculum. Current statue requires TBPC to administer and supervise the child care program. Because child care policies are not one of the core competencies of TBPC, this legislation transfers these responsibilities to the Health and Human Services Commission (HHSC). TBPC would still be responsible for providing a facility and all facility needs for child care providers selected by the Health and Human Service Commission.
RULEMAKING AUTHORITY
It is the committee's opinion that rulemaking authority is expressly granted to the executive commissioner of the Health and Human Services Commission in SECTION 5 of this bill.
ANALYSIS
Amends Section 663, Government Code, relating to child care facilities for state employees, by changing the definition of “commission” from General Service Commission to Health and Human Service Commission (HHSC); Conforming changes are made throughout Chapter 663. Requires TBPC to lease a site for a child care facility to a child care provider selected by HHSC. Functions and activities related to Chapter 663 of the Government Code performed by TBPC before November 1, 2005 are transferred to HHSC on that date.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
