AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Currently the Texas Building and Procurement Commission (commission) is required to achieve a space allocation ratio of not more than an average of 135 square feet per agency employee, when practical to do so. Many agencies have responsibilities and job functions that necessitate more than an average of 135 square feet per employee. Currently the commission may give agencies more or less than 135 square feet per employee. However, agencies feel like they are out of compliance when the commission assigns them more than 135 square feet per employee.
H.B. 2379 directs the commission to adopt rules consistent with private sector standards and industry best practices to govern the allocation of space.
RULEMAKING AUTHORITY
Rulemaking authority is expressly granted to the Texas Building and Procurement Commission in SECTION 1 (Section 2165.104, Government Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 2165.104(c), Government Code, to require the Texas Building and Procurement Commission (commission) to adopt rules consistent with private sector standards and industry best practices to govern the allocation of space. Requires the commission to exempt certain agency sites from rules adopted under this subsection. Deletes existing text prohibiting the commission from allocating office space above a certain space-to-employee ratio to specified state agencies. Deletes existing text requiring the agency, if it allocates its own office space, to allocate the space to achieve the desired ratio. Deletes existing text setting forth to which agency sites this subsection does not apply. Makes conforming changes.
SECTION 2. Effective date: September 1, 2005.
