BACKGROUND AND PURPOSE

 

Currently, as outlined in statute, the composition of the Advisory Committee to the Texas Board of Criminal Justice on Offenders with Medical or Mental Impairments is comprised of 31 members. Each member is an executive head of an agency, agency division, or association with an interest in offenders with special needs.  HB 2384 expands the membership of the Advisory Committee to include the chairs of both the Texas Board of Pardons and Paroles and the Correctional Managed Health Care Committee.  This bill also updates the membership to reflect organizational changes relating to the powers and duties of the Health and Human Services Commission made by HB 2292, 78th legislature.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 2384 amends Section 614.002 (a), Health and Safety Code, to change the membership of the Advisory Committee to the Texas Board of Criminal Justice on Offenders with Mental or Medical or Mental Impairments from 31 members to 32 members.

 

HB 2384 also amends Section 614.002 (e), Health and Safety Code, to specifically change the membership of the Advisory Committee.  This includes replacing The Texas Department of Mental Health and Mental Retardation with the Department of State Health Services, the Texas Rehabilitation Commission with the Department of Assistive and Rehabilitative Services, the Texas Commission on Alcohol and Drug Abuse with the Board of Pardons and Paroles, the Texas Department of Human Services with the Health and Human Services Commission, and the Texas Department of Aging with the Department of Aging and Disability Services.  HB 2384 also adds the Correctional Managed Health Care Committee to the Advisory Committee's membership.

 

All of the changes in Section 614.002 (e) are conforming changes, with the exception of adding the Board of Pardons and Paroles and the Correctional Managed Health Care Committee to the Advisory Committee membership.

 

EFFECTIVE DATE

 

September 1, 2005.

 

EXPLANATION OF AMENDMENTS

 

Amendment 1 by Noriega strikes the Criminal Justice Policy Council from the Advisory Committee and adds the Correctional Managed Health Care Committee.  Criminal Justice Policy Council was diminished last session.  The amendment makes appropriate changes to the Texas Alliance for Mentally Ill, which was renamed last session to the "National Alliance for the Mentally Ill."

 

This amendment also keeps the membership at the current 31 members.
