AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Due to unexpected circumstances, a county commissioners court may find it necessary to transfer funds within a county budget to cover emergency items with the county budget.  Section 111.070, Government Code, permits a commissioners court to amend the budget in order to transfer an amount budgeted for one item to another budgeted item by an order of the commissioners court.

 

H.B. 2458 permits a commissioners court to designate the county budget officer or another officer or employee of the county to amend the budget and make such a transfer.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 111.070(c), Local Government Code, to authorize the commissioners court by order to designate the county budget officer or another officer or employee of the county who may, as appropriate and subject to conditions and directions provided by the court, amend the budget by transferring amounts budgeted for certain items to other budgeted items.

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
