BACKGROUND AND PURPOSE

 

This bill would amend the Texas Health and Safety Code, Section 361.423 to eliminate the Texas Recycling Market Development Board and establish joint coordination of recycling activities by the Texas Commission on Environmental Quality (TCEQ) and the Texas Building and Procurement Commission (TBPC) with the entities maintaining the functions and activities.  The bill would also amend the Texas Government Code, Section 2155.448(a), to eliminate its reference to the Board.

 

The bill would ensure the validity of any action taken by the Board before its abolishment not be affected by the abolishment.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

Eliminates the Texas Recycling Market Development Board and adds the TCEQ,  the TBPC, and other consenting state agencies as appropriate.  The validity of actions by the Board prior to the abolishment is not affected by the abolishment.

 

EFFECTIVE DATE

 

September 1, 2005
