AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
H.B. 2496 amends the Transportation Code to require toll road authorities, the county authority, and the regional authority to notify the public through newspaper postings about hearings about possible toll road plans.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter A, Chapter 284, Transportation Code, by adding Section 284.010, as follows:
Sec. 284.010. PUBLICATION OF NOTICE OF PUBLIC HEARING. Requires notice of a public hearing required by Section 284.009 (Conveyance of State Highway to County or Toll Road Authority) to be published at least once a week for two consecutive weeks in the Texas Register and in each newspaper specified by that section. Requires the first publication to be not later than 30 days before the date of the hearing.
SECTION 2. Amends Section 362.0041(b), Transportation Code, to make conforming changes.
SECTION 3. Amends Section 366.035(d), Transportation Code, to make conforming changes.
SECTION 4. Amends Section 370.035(e), Transportation Code, to make conforming changes.
SECTION 5. Makes application of this Act prospective to a public hearing conducted after the 30th day after the effective date of this Act.
SECTION 6. Effective date: upon passage or September 1, 2005.
