BACKGROUND AND PURPOSE
There is a need for clarification regarding the local administrative judge in El Paso County. This bill is intended to set the procedure for selecting the local administrative judge.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
The bill adds subsection (h) to Section 75.014, Government Code, to provide that the judges of the district and county courts at law of El Paso County shall elect a judge of one of theses courts as local administrative judge for a term not to exceed 2 years.
EFFECTIVE DATE
Immediately on receipt of required vote, otherwise September 1, 2005
COMPARISON OF ORIGINAL TO SUBSTITUTE
The substitute removes the "notwithstanding" reference to Sections 74.091 and 74.0911, Government Code, in the original. The substitute makes "the council of judges" rather than "the judges" elect the local administrative judge. The substitute does not abolish offices of administrative judges as was done in original.
