BACKGROUND AND PURPOSE

 

Currently Chambers County and Liberty County share a district attorney, who serves the 253rd Judicial District.  Due to increased case loads, Chambers County would like its own district attorney.  HB 2569 would create a new office of district attorney in Chambers County.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill amends Section 43.170, Government Code, to provide that the voters of Liberty County elect a district attorney for the 253rd Judicial District who is restricted to Liberty County and cases in the 75th District Court. Prior law gave the district attorney responsibility for the 253rd and 344th as well. The bill also provides for an unlimited county supplement for this district attorney.

 

The bill also adds Section 43.1777 to the Government Code to provide that the voters of Chambers County elect a district attorney to represent the state in cases before the district courts of Chambers County. It also permits a county supplement up to $5000 per year.
