AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current state law provides for state-funded entities to give preference to veterans in hiring for open positions.  Most veterans have a high degree of work experience, training, and discipline that proves valuable in other forms of state service.

 

H.B. 2604 extends a veteran preference for entry into job training and employment assistance programs that are offered by state agencies.  It also extends this preference for entry into job training programs not run by state agencies that are at least partially funded by the state.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter A, Chapter 302, Labor Code, by adding Section 302.014, as follows:

 

Sec. 302.014.  VETERAN'S PREFERENCE IN JOB TRAINING OR EMPLOYMENT ASSISTANCE PROGRAMS AND SERVICES.  (a)  Defines "veteran."

 

(b)  Provides that a veteran qualifies for a preference under this section if the veteran qualifies for a veteran's employment preference under Section 657.002(a), Government Code.

 

(c)  Requires preference to be given to certain veterans in selecting applicants to receive training or assistance under a job training or employment assistance program or service that is funded wholly or partly with state money.

 

SECTION 2.  Provides that if Section 302.014, Labor Code, as added by this Act, conflicts with federal law or a limitation provided by a federal grant, Section 302.014, Labor Code, as added by this Act, is void and has no effect.

 

SECTION 3.  Effective date: September 1, 2005.
