BACKGROUND AND PURPOSE           

 

It is an established tradition that the State periodically names a highway or specified portion of a highway in honor of a person, event or significant feature of that roadway.  Dr. James A. (Jimmy) Turman was a four-term member of the Texas House of Representatives from Gober, Texas, in Fannin County, whose legislative career concluded with service as the 64th Speaker of the House.  CSHB 2647 designates Farm-to-Market Road 68 in Fannin County as Speaker Jimmy Turman Road.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 225, Transportation Code, by adding a new Section 225.059 which would (a) designate Farm-to-Market Road 68 in Fannin County as Speaker Jimmy  Turman Road, (b) require the department to design and construct markers indicating the road number, the designation of Speaker Jimmy Turman Road and any other appropriate information and (c) require the department to erect a marker at each end of the road and at appropriate sites along the road, (d) require grants or donation of private funds covering the cost of design, construction and erection of the marker before the department is required to design, construct or erect such marker and (e) require that monies received under (d) above be deposited in the state highway fund.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

SECTION 1.  Adds a new subsection (d) which requires grants or donations of private funds to cover the cost of design, construction and erection of a marker before the department is required to design, construct or erect such a marker.  Also adds a new subsection (e) which requires funds received under the new (d) above to be deposited in the state highway fund.
