BACKGROUND AND PURPOSE

 

The Lower Bois d’Arc Creek Reservoir project is a water supply project included in both the Region C Water Plan and the State Water Plan as a recommended water management strategy to help meet the future water supply demands of Region C, and the site of the Lower Bois d’Arc Creek Reservoir is recommended by the Texas Water Development Board in the State Water Plan as a site having unique value for reservoir construction.  H.B. 2679 provides for the designation of the Lower Bois d’Arc Creek Reservoir project site as a site of unique value for the construction of a dam and reservoir.  Texas Water Code Section 16.051 authorizes the Legislature to designate sites having unique value for reservoir construction.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.         Defines the Lower Bois d’Arc Creek Reservoir Project as a reservoir project identified for development in the current state and regional water plans.

 

SECTION 2.         Sets forth legislative findings.

 

SECTION 3.         Designates the site of the Lower Bois d’Arc Creek Reservoir Project as a site of unique value for the construction of a dam and reservoir.  Determines that the Lower Bois d'Arc Creek Reservoir Project is necessary to meet identified water supply requirements in Region C of the state plan.

 

EFFECTIVE DATE

 

H.B. 2679 takes effect immediately if it receives a 2/3rds vote in both chambers, otherwise it takes effect Sept. 1, 2005.
