BACKGROUND AND PURPOSE

 

The Texas Department of State Health Services employs guidelines for how mold assessors and remediators are licensed in the state of Texas.  The current examination requires that mold assessors and remediators attain a minimal score of 80%. All other examinations administered by the department require a minimum passing score of 70% in order for applicants to obtain a license.

 

H.B. 2746 proposes to equalize the standards used by the Texas Department of State Health Services so that all examination requirements are set at 70%. This provision ensures that all examination requirements are fair and not overly restrictive of one classification, while still allowing fully qualified applicants to obtain licenses. Without these criteria we limit a pool of able bodied and qualified applicants to be licensed mold remediators and assessors.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Section 1958.105, Occupations Code, by requiring the applicant to pass the examination with a score of 70 percent or more, if the department requires an examination.

 

SECTION 2.  Application of the Act.

 

SECTION 3.  Effective date: September 1, 2005.
