BACKGROUND AND PURPOSE

 

The Texas Military Preparedness Commission was created in the 78th Legislative Session by SB 652 to assist communities in accomplishing economic development projects that support the military.  The Texas Military Preparedness Act of 2003 was designed by state government and defense community leaders working together as a proactive response to the evolving transformation of national defense strategies and the infrastructure changes required to support them.  This bill furthers that goal by allowing defense communities to lease facilities to the federal government to enhance the value of a military facility near the community.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

This bill allows a municipality that is a defense community to acquire land, buildings, and facilities for the purpose of leasing them to the federal government to enhance the military value of a military facility located in or near the community.  It also states that a municipality with at least 50,000 people which takes this action, may provide for the principal or interest on the bonds issued by taking any part of municipal revenue that is not prohibited from being used for that payment.

 

EFFECTIVE DATE

 

The Act takes effect immediately if it receives the necessary vote, otherwise it takes effect September 1, 2005.
