AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Employees of the State of Texas who are involved with purchasing decisions are not currently required by statute to disclose family relationships involving vendors.  H.B. 2932 requires these state employees to disclose such relationships.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter A, Chapter 2262, Government Code, by adding Section 2262.004, as follows:

 

Sec. 2262.004. REQUIRED NEPOTISM DISCLOSURE. (a) Defines "major stockholder" and "purchasing personnel."

 

(b) Requires each of the state agency's purchasing personnel working on a contract to disclose certain information in writing, before a state agency can award a major contract for the purchase of goods or services to a business entity.

 

(c) Requires the state auditor to develop a form for use in reporting a relationship under Subsection (b).

 

(d) Provides that this section applies as specified, notwithstanding Section 2262.001 (Definitions) or 2262.002 (Exemptions).

 

SECTION 2. Makes application of Section 2262.004, Government Code, as added by this Act, prospective.

 

SECTION 3.  Effective date: September 1, 2005.
