BACKGROUND AND PURPOSE
In the 78th Legislative Session, the Texas Legislature passed HB 1858 which amended Chapter 47 of the Texas Agriculture to create the Shrimp Marketing Program. The Program, which is administered by the Texas Department of Agriculture was to be funded at a minimum level of $250,000.00 per year through transfers made by the Texas Parks & Wildlife Department. Sections 7 and 8 of the bill provide revenue sources to fund the Program, including a surcharge on certain shrimp related licenses issued by the Texas Parks and Wildlife Department pursuant to Sections 47.009, 47.011, 47.013, 77.031 and 77.035, of the Parks and Wildlife Code.
According to Sections 9 and 10 of the bill, the surcharge was limited to an increase of up to 10 percent of the license fees established by Texas Parks and Wildlife Department effective September 1, 2002, pursuant to Sections 47.009, 47.011, 47.013, 77.031 and 77.035, of the Parks and Wildlife Code.
Sections 9 and 10 of HB 1858, fixing the referenced license fees and surcharge, is due to expire September 1, 2005. HB 2942 extends the life of the bill passed in the 78th Legislative Session to September 1, 2007.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
HB 2942 Amends Section 47.021 and Section 77.049 of the Parks and Wildlife Code by extending the date that the sections expire to September 1, 2007.
Section. 47.021 prohibits fees issued under Sections 47.009, 47.011, and 47.013 from being increased by more than 10 percent of the amount of the fee set by the Texas Parks and Wildlife Commission effective on September 1, 2002. This section also provides that the section will expire September 1, 2007.
Section 77.049 prohibits fees issued under Sections 77.031 and 77.035 from being increased by more than 10 percent of the amount of the fee set by the Texas Parks and Wildlife Commission effective on September 1, 2002. This section also provides that the section will expire September 1, 2007.
EFFECTIVE DATE
This Act takes effect August 29, 2005
