BACKGROUND AND PURPOSE

 

District judges in Grimes, Madison, Leon and Walker Counties are required to do a great deal of traveling in order to attend juvenile board meetings, which are composed of the local county judge and the district judges for each particular county.   Although the board members are often required to travel great distances to carry out this task, they are only supplemented an additional compensation amount not to exceed $300 for the entire year.   This amount has proven to be inadequate in recent years, given the responsibility, travel and time involved.    

 

This bill raises the compensation that the juvenile board members are paid to no less than $1200 annually for the juvenile board members in Grimes, Madison Leon and Walker Counties.  Additionally, C.S.S.H.3045 clarifies that the juvenile board for Leon County is composed of the county judge and the district judges in Leon County.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.              Amends Section 152.0991(b), Human Resources Code, by requiring that                                        the commissioners court pay the juvenile board members additional                                                 annual compensation of no less than $1,200 annually in equal monthly                                            installments from the general fund of the county.

 

SECTION 2.              Amends Section 152.1511(a) and (b), Human Resources Code, by                                                  providing that the juvenile board of  Leon County be composed of the                                           county judge and the district judges in Leon County.  Additionally, the                                          commissioners court must pay the juvenile board members no less than                                      $1,200 annually in equal monthly installments from the general fund of                                             the county.

 

SECTION 3.              Amends Section 152.1631(b), Human Resources Code, by requiring the                                         commissioners court to pay the juvenile board members additional annual                                       compensation set by the commissioners court at not less than $1200                                                annually payable in equal monthly installments from the general fund of                                            the county. 

 

SECTION 4.              Amends Section 152.2421(b), Human Resources Code, by requiring that                                        the commissioners court pay the juvenile board members additional                                                 annual compensation of no less than $1,200 annually in equal monthly                                            installments from the general fund of the county.

 

SECTION 5.              This Act takes effect immediately if it receives a vote of two-thirds of all                                       the members elected to each house, as provided by Section 39, Article III,                                                 Texas Constitution. If this Act does not receive the vote necessary for                                            immediate effect, this Act takes effect September 1, 2005.

C.S.H.B3045 modifies the original H.B.3045 by striking Section 5 of the original version, which was inadvertently added in a drafting error and should be removed.
