BACKGROUND AND PURPOSE

 

The Sexual Assault Prevention and Crisis Services Program in the Attorney General's Office was transferred from the Texas Department of Health to the Office of the Attorney General in 1997 by HB 2561 (75th Legislature). The program is now operated as part of the Attorney General's Crime Victims Service Division.  As part of the transfer all statutory references were to also be changed to reflect that the program was now located in the Attorney General's Office, however, it appears a reference in Art. 57.02 (a) of the Code of Criminal Procedure was overlooked.  HB 3154 is purely a clean-up bill. It changes the reference to Texas Department of Health in Art. 57.02 (a) to the office of the attorney general.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Changes the reference to the "Texas Department of Health" in Art. 57.02 (a), Code of Criminal Procedure to "office of the attorney general".


SECTION 2. Sets an effective date of September 1, 2005.
