AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, the members of the Texas Military Preparedness Commission (commission) travel the state on a regular basis to visit defense-dependent communities.  The commission is currently experiencing fatigue from excessive travel.  Increasing the number of members would assist in relieving these concerns by spreading responsibilities to more members.

 

H.B. 3163 increases the number of members on the commission from nine to 13. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Reenacts and amends Section 436.051, Government Code, as renumbered from Section 436.003, Government Code, by Section 3, Chapter 149, Acts of the 78th Legislature, Regular Session, 2003, and Section 436.003, Government Code, as amended by Section 8, Chapter 1328, Acts of the 78th Legislature, Regular Session, 2003, as follows: 

 

Sec. 436.051.  COMPOSITION; ELIGIBILITY.  Provides that the Texas Military Preparedness Commission (commission) is composed of 13, rather than nine,  members, appointed by the governor. 

 

SECTION 2.  Amends Section 436.052(a), Government Code, to provide that the 13 public members of the commission serve staggered terms of six years with the terms of four or five members, rather than one-third of the members, expiring February 1 of each odd-numbered year. 

 

SECTION 3.  (a)  Requires the governor, not later than October 1, 2005, to appoint the four additional public members of the commission as required by Section 436.051, Government Code, as amended by this Act.  Requires the governor to appoint certain members to serve a term expiring at a specific date. 

 

(b)  Provides that until all of the members appointed under this section have qualified for office, a quorum of the commission is a majority of the number of members who have qualified for office. 

 

SECTION 4.  Effective date:  September 1, 2005.
