BACKGROUND AND PURPOSE
The Aircraft Pooling Board (APB) was created in 1979 by the 66th Legislature to establish and operate a pool for the custody, control, operation and maintenance of aircraft owned or leased by the state. The APB is currently located at Austin - Bergstrom Int'l Airport in Austin, in a facility that includes aircraft hangar and maintenance areas, fuel facilities, a passenger lobby and offices. H.B. 3285 abolishes the APB, directing the sale of the APB's equipment and turning control of the property over the Texas Department of Transportation.
RULEMAKING AUTHORITY
It is the author's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
H.B. 3285 amends Subchapter C, Chapter 85, Education Code, by adding Section 85.285 which establishes guidelines for an university system aircraft. In addition, H.B. 3285 abolishes the Aircraft Pooling Board (the Board), eliminating all employee positions on the Board, nullifying all contracts and understandings with between the Board and the Texas Department of Transportation (TxDOT), and repealing laws relating to the Board. Directs the sale of aircraft and aircraft-related equipment and the Board's facility. Gives TxDOT control over the property formerly operated by the Board, limiting the use of the property by TxDOT to use for an intelligent transportation system and lease of any unneeded portion of the property.
