BACKGROUND AND PURPOSE

 

Currently holders of a structural pest control business license are not required to complete any continuing education requirements.  This bill would require that the Structural Pest Control Board establish a continuing education requirement as a condition for renewal of a license. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that rulemaking authority is expressly granted to the Texas Structural Pest Control Board in SECTIONS 1 & 2 of this bill. 

 

ANALYSIS

 

Amends Occupations Code, by adding a section which would require that the Structural Pest Control Board establish a continuing education requirement as a condition for renewal of a structural pest control business license.  This would be, at minimum, four hours of instruction annually in relevant areas of state law.  The board will also be required to approve one or more courses that meet these minimum requirements.  This bill also allows the board to adopt fees to recover the costs of implementing this program.

 

EFFECTIVE DATE

 

This Act takes effect September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

CSHB 3318 clarifies that it is the business license holder that must complete the continuing education.  CSHB 3318 also adds subsection (b) which allows the board to adopt fees necessary to recover the board's costs in implementing the continuing education.
