BACKGROUND AND PURPOSE

 

Interlocal cooperation contracts increase the efficiency and effectiveness of local governments by authorizing them to contract, to the greatest possible extent, with one another and with agencies of the state.  Currently, community colleges and workforce development boards work together on projects to train workers but are not statutorily allowed to enter into interlocal cooperation contracts.  Giving these entities this option would allow them to enter into local agreements in shorter time periods rather than the lengthy standard contracting process.

 

The committee substitute to House Bill 3384 adds junior colleges and local workforce development boards to the definition of a local government for the purpose of entering into interlocal agreements.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1    Amends Section 791.003(4), Government Code, to include a junior college district and a local workforce development board created under Sec. 2308.253, Government Code, in the definition of a "local government."

 

SECTION 2    The Act takes effect immediately if it receives a two-thirds vote of all members elected to each house.  Otherwise, the Act takes effect September 1, 2005.

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute is a Legislative Council draft of the introduced version of the bill.  The introduced version referenced an incorrect section of the Government Code.
