AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Antique license plates were created last session to allow certain antique vehicle owners to have a reduced registration fee.  Because the registration is reduced, vehicle use is restricted to exhibitions, club activities, parades, and similar public functions.

 

H.B. 3425 provides an exception for prosecution of an offense if an antique vehicle is en route to or from a location for maintenance purposes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 504.502, Transportation Code, by adding Subsection (j), as follows:

 

            (j)  Provides that it is an affirmative defense to prosecution of an offense under this           section (Certain Exhibition Vehicles; Offense), that at the time of the offense the vehicle    was en route to or from a location for the purpose of routine maintenance of the vehicle.

 

SECTION 2.  Effective date:   September 1, 2005.
