BACKGROUND AND PURPOSE

 

The Bee Groundwater Conservation District has in its enacting legislation governance by  both Chapters 36 and 49 of the Water Code.  The district only uses the guidelines set out in Chapter 36.  The board and the administration of the Bee Groundwater Conservation District has asked for HB 3496 as cleanup language.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

 

ANALYSIS

 

SECTION 1. Eliminates Chapter 49 of the Water Code from the Bee Groundwater Conservation District enabling legislation.

 

SECTION 2  Sets the effective date of the bill.   

 

EFFECTIVE DATE

 

This Act takes effect September 1, 2005.
