BACKGROUND AND PURPOSE

 

Currently, directors of the Lake Cities Municipal Utility Authority (LCMUA) are elected at large by a simple majority vote.  In order to more effectively serve the jurisdiction of the LCMUA, the Authority wants to move to elections by the place system, with each director serving for four years.  The revision sought by H.B. 3508 allows for each director to be elected at large to one of five numbered places (1 through 5), each serving four year terms.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.         Amends Section 6(b), Chapter 1137, Acts of the 76th Legislature, Regular Session, 1999, to allow each director of the Lake Cities Municipal Utility Authority to be elected at large to one of five numbered places.
 
SECTION 2.         The directors serving on the effective date of this Act shall draw lots to determine which place each director serves.  Places one and two shall be drawn for by the two directors whose terms expire in 2006.  The three directors whose terms expire in 2008 shall draw lots for places three, four and five.
 
SECTION 3.         Chapter 312, Acts of the 58th Legislature, Regular Session, 1963, is repealed.                             
 
SECTION 4.         Effective date.

 

 

EFFECTIVE DATE

 

This act takes effect on September 1, 2005.
