BACKGROUND AND PURPOSE

 

The Act creating the Lynn County Hospital District (district) was passed by the 60th Legislature in 1967 and amended by the 73rd Legislature in 1993.  The district would like to revise the legislation to establish requirements for membership and provide for legal removal of members out of compliance.  The district would also like to require members to attend at least 3/4 of regularly scheduled board meetings.  Further, the district would like to require board members to be current on all federal, state, or local taxes, including ad valorem taxes.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Chapter 66, Acts of the 60th Legislature, Regular Session, 1967, by adding Section 4A, to require members of the board of directors to attend at least 3/4 of the regularly scheduled board meetings.  The bill further amends the enabling legislation to require members of the board of directors to be current on all federal, state, or local taxes, including ad valorem taxes.  The bill further amends the enabling legislation to establish procedures for removal of members of the board of directors.  The bill further amends the enabling legislation to provide that the district’s actions for removal of members of the board of directors shall follow the general procedures set out in Chapter 66 of the Civil Practice and Remedies Code as appropriate. 

 

SECTION 2.   Effective Date

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
