BACKGROUND AND PURPOSE

 

Currently the Comal County Juvenile Board  (the ABoard@) has five members, including the county judge, the judge of the 207th District Court, an additional district court judge having jurisdiction in Comal County, the local administrative statutory county court judge and the criminal district attorney for Comal County.  Upon the creation of a second county court at law, the Board composition needs to be changed to include both county court law judges.

 

Under H.B.3515, the Board would be composed of the county judge, the judge of each county court at law in the county, the judge of the 207th District Court, an additional judge of the district courts having jurisdiction in Comal County and the criminal district attorney.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.              Amends Section 152.0521(a) of the Human Resources Code to provide                                          that the Comal County Juvenile Board be composed of the county judge;                                       the judge of each county court at law in the county; the judge of the 207th                                         District Court; an additional judge of the district courts having jurisdiction                              in Comal County, to be appointed biennially by the local administrative            

                                    district judge; and the criminal district attorney of Comal County.  

 

SECTION 2.              This Act takes effect immediately if it receives a vote of two-thirds of all                                       the members elected to each house, as provided by Section 39, Article III,                                                 Texas Constitution. If this Act does not receive the vote necessary for                                            immediate effect, this Act takes effect September 1, 2005.
