AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Williamson County Municipal Utility District No. 21 will encompass approximately 530 acres of land in Williamson County, outside the extraterritorial jurisdiction of the City of Georgetown. The land to be located within the district will be developed into single family residential and commercial developments; therefore, water, sewer, and drainage services need to be secured. It is necessary to create the municipal utility district under Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, in order to purchase, acquire, and/or construct facilities for such services to serve the future occupants of the land utilizing tax exempt bonds.
H.B. 3549 provides regulations regarding the creation, administration, powers, duties, operation, and financing of the district, and provides authority for the district to divide into smaller districts.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8132, as follows:
CHAPTER 8132. WILLIAMSON COUNTY MUNICIPAL UTILITY
DISTRICT NO. 21
Sets forth standard language for the creation of the Williamson County Municipal Utility District No. 21 (district) in Williamson County. Sets forth standards, procedures, requirements, and criteria, for:
Creation, approval of the district, inclusion of certain territory, and applicability of law (Sections 8132.001-8132.005);
Size composition, meetings, confirmation, and terms of the temporary board of directors of the district (Sections 8132.021-8132.025);
Terms and election of board of directors of the district (Sections 8132.051-8132.052); and
Powers and duties of the district (Sections 8132.101-8132.103).
Does not authorize the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: September 1, 2005.
