BACKGROUND AND PURPOSE

 

In the 77th Legislative Session House Bill 1362 was passed to regulate the ownership of wild animals which gave the authority to regulate the possession of dangerous wild animals to municipal and county authorities.  HB 3572 provides relief for licensed trappers and others whose regular business activities necessitate and include possession and control of dangerous wild animals.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1:   Sets for the definition for a Licensed Trapper.

 

SECTION 2:   Amends Section 822.102(a) of the Health and Safety Code to specify that this subchapter does not apply to:

(1)        Certain counties, municipalities, or agencies;

(2)        Certain research facilities;

(3)        An organization that is an accredited member of the American Zoo and Aquarium Assoc.;

(4)        An injured, infirm, orphaned, or abandoned dangerous wild animal being transported for care or treatment;

(5)        An injured, infirm, orphaned, or abandoned dangerous wild animal being rehabilitated, treated, or cared for;

(6)        A dangerous wild animal owned or controlled by a transient circus company under certain conditions;

(7)        A dangerous wild animal temporarily in the custody or control of a television or motion picture production company during filming;

(8)        A dangerous wild animal owned or controlled by a college or university as a mascot;

(9)        A dangerous wild animal being transported in interstate commerce;

(10)      A nonhuman primate owned or controlled by a person whose only business is supplying nonhuman primates to biomedical research facilities with a dealer's license;

(11)      A dangerous wild animal that is owned or in the possession of a person who is a participant in a species survival plan of the American Zoo and Aquarium Association and an integral part of that species survival plan; and

(12)      A cougar, bobcat, or coyote in the possession custody or control of a licensed trapper.

 

SECTION 3:   This Act takes effect September 1, 2005
