AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Kingsborough Municipal Utility Districts Nos. 1, 2, 3, 4, and 5 of Kaufman County (the ADistricts@ or "District") are existing municipal utility districts created by Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003. The districts are located within the extraterritorial jurisdiction of the City of Crandall, Texas. The land located within the districts are being developed into single family residential and commercial development. H.B. No. 3582 amends the boundaries of the districts.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 5, Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003, to set forth the amended boundaries of Kingsborough Municipal Utility Districts Nos. 1, 2, 3, 4 and 5.
SECTION 2. Amends Section 10(b), Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003, to authorize a district, outside the boundaries of a district, to exercise the power of eminent domain only for certain services, including drainage systems.
SECTION 3. Amends Section 12(b), Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003, to delete existing text relating to this section being subject to Subsection (c).
SECTION 4. Amends Section 15, Chapter 15, Chapter 1299, Acts of the 78th Legislature, Regular Session 2003, as follows:
Sec. 15. New heading: EFFECTIVE DATE. Deletes existing Subsection (b) relating to the creation and confirmation election.
SECTION 5. Repealer: Section 12(e), Chapter 1299 (Appointment of Temporary Directors), Acts of the 78th Legislature, Regular Session, 2003.
SECTION 6. Effective date: September 1, 2005.
