BACKGROUND AND PURPOSE
Kingsborough Municipal Utility District Nos. 1, 2, 3, 4 and 5 of Kaufman County (the ADistricts@ or "District") are existing municipal utility districts created by Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003. The Districts are located within the extraterritorial jurisdiction of the City of Crandall, Texas. The land located within the Districts are being developed into single family residential and commercial development. H.B. No. 3582 amends the boundaries of the Districts.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Amends Section 5, Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003, as follows:
Sec. 5. BOUNDARIES. Amends the boundaries of Kingsborough Municipal Utility District Nos. 1, 2, 3, 4 and 5.
SECTION 2. Amends Section 10(b), Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003 as follows:
(b) Provides that a district may exercise the power of eminent domain outside the boundaries of a district for drainage systems.
SECTION 3. Amends Section 12(b), Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003 as follows:
(b) Provides that temporary directors of a district may be appointed by the Commission upon receipt of a petition.
SECTION 4. Amends Section 15, Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003 as follows:
Sec. 15. Deletes reference that if the creation of a district is not confirmed at a confirmation election before September 1, 2005, the provisions of this Act relating to that district expire on that date.
SECTION 5. Repeals Section 12(e), Chapter 1299, Acts of the 78th Legislature, Regular Session, 2003.
SECTION 6. Act takes effect September 1, 2005.
