AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Currently, Texas is in need of statewide leadership and coordination on indigent health care programs. S.B. 44 restores the Indigent Health Care Advisory Committee (committee) which was repealed by H.B. 2292, 78th Legislature, by incorporating it in statute. The committee would allow appointed representatives to advise the executive commissioner of Health and Human Services on rules and policies concerning indigent health care services.
RULEMAKING AUTHORITY
This act does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter A, Chapter 61, Health and Safety Code, by adding Section 61.012, as follows:
Sec. 61.012. INDIGENT HEALTH CARE ADVISORY COMMITTEE. (a) Requires the executive commissioner of the Health and Human Services Commission (commission) to establish an advisory committee to advise the commission on rules and policies concerning indigent health care services.
(b) Requires the committee to consist of 11 members, including four consumers or persons representing consumers and seven other representatives, appointed by the executive commissioner.
(c) Sets forth requirements for the advisory committee.
(d) Makes Chapter 2110 (State Agency Advisory Committees), Government Code, inapplicable to the size or composition of the advisory committee.
(e) Requires the commission, not later than November 1 of each even-numbered year, to submit a report regarding the advisory committee's recommendations to specific legislative members.
(f) Provides that this section expires September 1, 2007.
SECTION 2. Effective date: September 1, 2005.
