AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The current personal needs allowance of $45 for residents of certain long-term care facilities who receive medical assistance is inadequate to meet the rising cost of living.  C.S.S.B. 199 seeks to increase the personal needs allowance of residents in long-term care facilities who receive medical assistance.  C.S.S.B. 199 increases the minimum personal needs allowance to no less than $60 per month, subject to the availability of funds.  This allowance is meant to enable residents to purchase simple goods and services that can help maintain feelings of control over their lives.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 32.024(w), Human Resources Code, by increasing the minimum personal needs allowance for residents of certain long-term care facilities who receive medical assistance from $45 to not less than $60 a month, subject to availability of funds.

 

SECTION 2.   Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2005.
