AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, there are no regulations which require school districts to make a declaration to protect students from discrimination.

 

As proposed, S.B. 201 requires school districts to place in their polices a regulation protecting students from discrimination based on ethnicity, color, gender, gender identity, sexual preference, disability, religion, or natural origin.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 1, Education Code, by adding Section 1.0021, as follows:

 

Sec. 1.0021.  DISCRIMINATION PROHIBITED.  (a)  Defines "sexual preference."

 

(b)  Prohibits a public educational institution or employee of a public educational institution from discriminating against a student enrolled in the institution on account of the ethnicity, color, gender, gender identity, sexual preference, disability, religion, or natural origin of the student or the student's parent.

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
