BACKGROUND AND PURPOSE

 

Section 406.014 of the Government Code requires notaries public to keep written records in a book. CSSB 220 would update this requirement by allowing a notary public to maintain the required records electronically in a computer or other storage devise.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

CSSB 220 amends Section 406.014 of the Government Code by allowing a notary public to maintain the required records in Section 406.014(a) electronically, in a computer or other storage device.

 

EFFECTIVE DATE

 

September 1, 2005

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

CSSB 220 deletes any provision in SB 220 that would require a notary public to keep in a book a record of the date of each notarization and the signature of the signer, grantor, or maker.
