BACKGROUND AND PURPOSE
Almost four decades ago, when the Texas Legislature established The University of Texas at Dallas, and again approximately two decades ago when the legislature authorized the university to enroll freshmen and sophomore students, the authorizing legislation included language placing restrictions and limitations on the university’s programs and enrollments. S.B. 254 repeals these various limitations, restrictions, and mandates to eliminate the risk that in the future they might constitute potential or perceived impediments to the university as it continues to meet the needs of the citizens of Texas.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Repealer: Sections 70.05 (Programs at Other Universities) and 70.08 (Undergraduate Admissions), Education Code.
SECTION 2. Effective date:
EFFECTIVE DATE
This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
