AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Investigators for the State Board of Pharmacy were added to the law enforcement officers class of the Employees Retirement System late in the 75th session with no discussion or consideration.  Since then, the investigators have enjoyed the extra ".5 multiplier" that the officers for the Department of Public Safety, Parks and Wildlife Department, and Alcoholic Beverage Commission have had since the law enforcement officers retirement section was incepted in 1979.

 

S.B. 262 removes any future investigators employed by the State Board of Pharmacy from Section 811.009(9), Government Code, and place those investigators in the standard class of the Employees Retirement System.  

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 811.001(9), Government Code, to redefine "law enforcement officer" by deleting text which included a member of the Employees Retirement System commissioned as a law enforcement officer by the State Board of Pharmacy within the definition.  Makes nonsubstantive changes.  

 

SECTION 2.  Amends Section 814.104(b), Government Code, to make a conforming change. 

 

SECTION 3.  Amends Section 815.505, Government Code, to make a conforming change. 

 

SECTION 4.  Makes application of this Act prospective.

 

SECTION 5.  Effective date: September 1, 2005.
