AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Under current law, individuals are not empowered to file for an injunction prohibiting violations of state law by automotive wrecking and salvage yards.  S.B. 280 provides individuals with the ability to file for such injunctions to prevent a violation of the law.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subdivision (1), Section 396.001, Transportation Code, by redefining "automotive wrecking and salvage yard."

 

SECTION 2.  Amends Chapter 397, Transportation Code, by adding Section 397.014, as follows:

 

Sec. 397.014.  INJUNCTION.  (a)  Entitles a person to an injunction to prohibit a violation or threatened violation of this chapter.

 

(b)  Provides that the venue for the injunction proceeding is in the county to which this chapter applies in which any part of the automotive wrecking and salvage yard is located.

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
