AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 292 increases the driver's license reinstatement fee, providing that the revenue from the increase be returned to local governments in order to cover their cost of providing administrative license revocation services to the state. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 524.051, Transportation Code, by amending Subsections (a) and (c) and adding Subsection (d), as follows:

 

(a)  Prohibits a driver's license suspended under this chapter from being reinstated or reissued until the person pays the Department of Public Safety (department) a fee of $140, rather than $125, in addition to any other fee required by law.

 

(c)  Requires each fee collected under this section to be deposited to the credit of the Texas mobility fund, except as provided by Subsection (d).

 

(d)  Requires the department to remit $15 of each fee collected under Subsection (a) to the treasurer of the county if the person was arrested in a county that maintains a certified breath alcohol testing program but does not use the services of a certified technical supervisor employed by the department.  Authorizes money received by a county under this subsection to be used only to defray the costs incurred by the county for the use of the services of a certified technical supervisor employed by the county in connection with the enforcement of this chapter.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date:  September 1, 2005.
