AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The Harris County Municipal Utility district No. 388 was created by the 77th Legislature in anticipation of growth in the area.  The legislation establishing the district provided a specific date of September 2006 by which the district had to be confirmed by an election.  Because the pace of the development has not advanced as quickly as anticipated, the election cannot occur by that date. 

 

S.B. 428 provides an open date for the confirmation election to occur.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 14, Chapter 1383, Acts of the 77th Legislature, Regular Session, 2001, as follows:

 

Sec. 14.  New heading: EFFECTIVE DATE.  Effective date: September 1, 2001.  Deletes text providing an expiration date for this Act if the creation of the Harris County Municipal Utility District No. 388 is not confirmed at a confirmation election under Section 10 of this Act before September 1, 2006.

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
