BACKGROUND AND PURPOSE

 

The Harris County Municipal Utility District No. 387 was created by the 77th Legislature in anticipation of growth in the area.  The legislation establishing the district provided a specific date of September 2006 by which the district had to be confirmed by an election.  Because the pace of development has not advanced as quickly as anticipated, the election cannot occur by that date.  As proposed, S.B. 429 provides an open date for the confirmation election to occur. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 14, Chapter 1382, Acts of the 77th Legislature, Regular Session, 2001, to read as follows:

 

            Sec. 14.  New heading: EFFECTIVE DATE.  Deletes existing text providing that if the creation of the Harris County Municipal Utility District No. 387 is not confirmed at a confirmation election held under Section 10 of this Act before September 1, 2006, this act expires on that date.  Makes a nonsubstantive change. 

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
