AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

S.B. 496 validates the acts and proceedings of the governing board of navigation districts and public port authorities to reduce litigation and ensure the timely completion of projects.  This session, two corporations of ports will be added to the validation bill: local government corporations and port development corporations.  S.B. 496 prevents work stoppage on projects that would have been hampered by minor technicalities and can assist ports with lower insurance costs and better credit ratings.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  DEFINITION.  Defines "district."

 

SECTION 2. VALIDATION.  Sets forth validation and confirmation in all respects of any act, governmental proceeding, official, bond, or obligation of a navigation district or port authority or a corporation of the district or authority undertaken by one or more certain dates.

 

SECTION 3.  APPLICABILITY.  Sets forth acts to which Section 2 does not apply.

 

SECTION 4.  EFFECTIVE DATE.  Effective date: September 1, 2005.
