BACKGROUND AND PURPOSE

 

Current Texas law authorizes the Texas Water Development Board to allocate no more than 10 percent of the annual Water Infrastructure Fund budget for disadvantaged communities or for certain permitting costs.

 

SB 509 repeals Section 15.974(b), Water Code, to provide the Texas Water Development Board with maximum flexibility in determining which water-related financial needs to address with water infrastructure fund appropriations, if given funding by the legislature.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Repeals Section 15.974(b), Water Code, regarding the limits on financial assistance under the water infrastructure fund.

 

SECTION 2.  Effective date.

 

EFFECTIVE DATE

 

Upon passage or, if the Act does not receive the necessary vote, the Act takes effect September

1, 2005.
