BACKGROUND AND PURPOSE

 

This bill would allow a district judge in Nolan County to appoint one or more part time or full time magistrates to perform specified duties  to help with the court's caseload.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill adds a Subchapter BB to Chapter 54 of the Government Code  regarding magistrates in Nolan County which provides that the commissioners court of Nolan County may authorize the judge of the district court to appoint one or more magistrates and sets the qualifications of such magistrates.  The bill also provides for the salary, judicial immunity and powers of the magistrates.

 

EFFECTIVE DATE

 

Immediately on receipt of required vote, otherwise September 1, 2005

The substitute changes the reference to specific counties in the original bill to a statutory reference.
